The petitioner is in judicial custody since 12.06.2017 in connection with Barauni P.S.Case No. 439 of 2015 registered for offences punishable under Sections 341, 342, 323, 387, 504 and 34 of the Indian Penal Code.
The prosecution case as lodged by the informant is that he is working in Railways and on 02.12.2015 while he was proceeding after alighting from Koshi express, the petitioner along with other unknown persons snatched Rs. 25,000/- from his pocket.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.34184 of 2017 (2) dt.25-07-2017 2/2 petitioner that he is innocent has no criminal history, the petitioner is Uncle (phupha) of the informant's wife and there is some dispute regarding marriage of the informant for which the petitioner has been falsely implicated. F.I.R. has been lodged after delay of two days, although the Police Station is just four K.Ms. away from the place of occurrence.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P. S. Case No. 439 of 2015.
