JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 584/2013 instituted under Section 498A of the Indian Penal Code and Section 4 of the D.P.Act. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the complainant had married with the petitioner in the year 2010 and went to her inlaws house. It is further alleged that the father of the complainant gifted Rs. 4 lacs along with motor cycle but after some time the inlaws' family started demanding money and torturing and lastly she was ousted from the house.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.49893 of 2014 (2) dt.30-04-2015 2/2 petitioner is ready to keep the complainant as his wife with full dignity and honour.

Learned counsel for the State submitted that the petitioner is the husband of the complainant and there is specific allegation against him.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sasaram,Rohtas, in connection with Complaint Case No. 584 of 2013, subject to the conditions, as laid down u/s 438(2) Cr.P.C. with a further condition that the petitioner shall deposit an amount of Rs. 2500/- (twenty five hundred) per month before the court below and the same shall be released in favour of the complainant.
