This is an application for bail in connection with Bakhtiarpur P.S.Case No. 283 of 2014 registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR and it appears that his name transpires in the confessional statement of co-accused and he has been made accused in eight other cases. It has been submitted on behalf of the petitioner that except confessional statement of co-accused there is nothing against him and there is no recovery from his possession and no
Patna High Court Cr.Misc. No.34586 of 2017 (2) dt.31-07-2017 2/3 Test Identification Parade was held and he is in custody for more than a year. Further submission is that co-accused having similar allegation have been granted bail in Cr.Misc.No. 14214 of 2016, vide order dated 5.4.2016 and Cr.Misc.No.48674 of 2015, vide order dated 27.1.2016. It has further been submitted that charge has been framed in this case and he is ready to abide by any condition that may be imposed upon him by this Court if bail is granted to him.

Having heard both sides and considering the aforesaid facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Barh, in connection with Sessions Trial No. 503A of 2015, arising out of Bakhtiarpur P.S.Case No. 283 of 2014, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
Patna High Court Cr.Misc. No.34586 of 2017 (2) dt.31-07-2017 3/3 (iii) The petitioner shall cooperate in the disposal of trial and appear on each and every date except showing genuine reason, failing which his bail bond shall be cancelled.
