The petitioner seeks bail in a case registered under Sections 457/380 of the Indian Penal Code.

Allegedly, in the night of a day, unknown miscreants broke open the lock and entered the house of the informant. It is also alleged that Rs. 10,000/-, jewellery and other articles were stolen away by thieves.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 10-05-2019. Charge sheet has already been submitted. One ring and a golden locket are alleged to have been recovered from the petitioner. The

Patna High Court CR. MISC. No.56876 of 2019(2) dt.09-09-2019 2/2 petitioner has been falsely implicated in the present case due to mistake of fact. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Delha P.S. Case No. 103 of 2019.
