The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365/34 of the Indian Penal Code.

The accusation is of kidnapping the brother of the informant. In 164 Cr.P.C. statement the victim has supported the accusation.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled and the victim returned home of his own. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.54040 of 2015 (2) dt.27-11-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Banmankhi P.S. Case No. 278 of 2015 pending in the court of learned Chief Judicial Magistrate, Purnea.

With the aforesaid observation, this application is disposed of.
