The petitioner is in custody in connection with Sarai P.S.Case No.124 of 2016 pending in the Court of Additional Sessions Judge-I-cum-Special Judge (NDPS), Vaishali at Hajipur registered for an offence under Sections 307/34 of the IPC and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act. The informant of this case is the Sub-Inspector of Police, who, on confidential information during patrolling duty, arrived at village- Fatehpur and saw two persons coming on one motorcycle. The motorcyclist seeing the police party, started fleeing away. The informant, apprehended this petitioner and seized 1.675 K.G ganja, one loaded pistol along and three cartridges from his possession. The seizure was made in presence of two independent
Patna High Court Cr.Misc. No.33798 of 2017 (2) dt.20-07-2017 2/2 witnesses and a copy of seizure memo was handed over under his signature. He confessed the crime. Besides that the petitioner is accused in four more cases registered for the offence under Section 392 of the IPC and 25 of the Arms Act. Considering the recovery of ganja, loaded fire arm and ammunition and also his antecedent, I am not inclined to grant him bail. Accordingly, his prayer is rejected.
