The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a), 37(b) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 12 liters of country made liquor were recovered from the house of the petitioner. Petitioner claims his antecedent to be clean and he is in custody since 13.06.2017.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)

Patna High Court Cr.Misc. No.33716 of 2017() dt.20-07-2017 2/2 with two sureties of the like amount each to the satisfaction of A.D.J.-II-cum-Special Judge (Excise), Katihar in connection with Rautara P.S. Case No.51 of 2017.

However, before accepting the bail bonds, the court below would make verification regarding criminal antecedent of the petitioner and if he is found to be involved in any criminal case prior to filing of affidavit in this application, i.e., 12.07.2017, then he would not be released.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
