The petitioner apprehends his arrest in connection with Kusheshwar Asthan P.S. Case No. 59 of 2016 registered under Sections 448, 452, 341, 323, 379, 504, 498A and 34 of the I.P.C. and 3⁄4 of the Dowry Prohibition Act pending in the Court of S.D.J.M., Biraul, District-Darbhanga.

Learned counsel for the petitioner submits that petitioner, who happens to be husband of the informant, has falsely been implication in this. There is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission

Patna High Court Cr.Misc. No.52919 of 2016 (3) dt.20-04-2017 2/2 that petitioner is the husband and there is specific allegation of demand and assault against the petitioner.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
