2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.
3. As per the prosecution case, on 16.03.2021, the daughter of the informant went missing and it is alleged that the petitioner took away the daughter of the informant.
4. It is submitted on behalf of the petitioner that petitioner is innocent and after institution of the present case, the victim girl returned to her house and recorded her statement under Section 164 of Cr.P.C., wherein she stated that she went away with the petitioner voluntarily and solemnized
Patna High Court CR. MISC. No.62394 of 2023(2) dt.11-10-2023 2/2 marrige with him. The victim girl is major and she is living happily with the petitioner as his wife.
5. Considering the statement of the victim girl recorded under Section 164 of the Cr.P.C., this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judical Magistrate-I, Gaya in connection with Wazirganj P. S. Case No. 122 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Shishir/- U T
