JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-09-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Complaint Case No. 306 (C ) of 2014 for the offenses under Sections 420 and 406 of the Indian Penal Code. The allegation against the petitioner as per the complaint petition is that he and his son realized the consideration money of Rs. 2 lacs from the informant but refused to transfer the land.

Learned counsel for the petitioner submits that petitioner is 80 years old.

Considering the fact that the petitioner is 80 years

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Sri M. Mishara, Judicial Magistrate, 1st Class, Nalanda at Biharsharif in connection with Complaint Case No. 306 (C ) of 2014, subject to the condition that the petitioner shall not alienate any land without prior permission of the court below during the pendency of this case.
