====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 23.11.2015 passed in Cri. Misc. No. 32886 of 2015, on the ground that the petitioner is suffering in custody since 29.04.2015 without any cogent and liable material, there is no chance of tampering with the prosecution evidence and, as such, she deserves sympathetic consideration.
The learned A.P.P. opposes the prayer of bail by submitting that the doctor has also found the cause of death due to throttling and there is allegation that the petitioner throttled her five years old son to death.
Patna High Court Cr.Misc. No.36702 of 2017 (2) dt.09-08-2017 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, considering the detention of the petitioner, let the trail be expedited and concluded as early as possible preferably within six months from date of receipt/production of a copy of this order, failing which if the petitioner at no fault, may be at liberty to renew her prayer for bail.
