The petitioner is in judicial custody in connection with Forbesganj P.S. Case No. 786 of 2021 registered under Sections 457 and 380 of the Indian Penal Code. Direct allegation against him is that in their absence in the home, the theft was committed and his entire household items including cash amount of Rs. 5,35,000/- as well as jewelleries were stolen. When the C.C. TV footage was checked, it came to light that the petitioner herein has committed the theft crime along with his associates. Learned counsel for the petitioner submits that there is delay in lodging the FIR inasmuch as the allegation of theft
Patna High Court CR. MISC. No.71416 of 2021(2) dt.26-05-2022 2/2 relates to 21.09.2021 but the FIR was lodged on 28.09.2021. There is nothing on the petition to show that the allegation of the presence of the petitioner in the C.C. TV. Footage is wrong.
Considering the specific allegation against the petitioner that he was the person who has been captured in the C.C. TV. footage for committing theft of the household items and as also the amount of cash Rs. 5,35,000/- as well as jewelleries, this Court is not inclined to grant any relief to the petitioner.
The bail application of the petitioner is hereby rejected.
