JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in connection with a case registered under Sections 399 and 402 of the Indian Penal Code. As per prosecution case, on secret information received at the police station that some miscreants have assembled and are planning to commit dacoity, the police reached and surrounded them. The police apprehended the petitioner and one country made pistol is said to have been recovered from his possession. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. No incriminating article has been recovered from his possession. Other co-accused have been enlarged on bail by co-ordiante Benches of this Court. The petitioner is in custody since 02.12.2016.
