The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 270 litres of country made liquor were recovered from a vehicle. Petitioner is stated to be driver of the aforesaid vehicle. Petitioner claims that he is having clean antecedent and is in custody since 07.05.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.38966 of 2017(2) dt.19-08-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. 2nd -cum- SPL Court Excise, Buxar in connection with Rajpur P.S. Case No. 94 of 2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
