The present petition has been filed with a prayer to restore M.A. No. 461 of 2011, which stood dismissed due to noncompliance of order dated 06-12-2012, whereby, peremptory order was issued for filing requisites in respect of service of notice on respondent no. 1.
Learned counsel for the petitioner submits that though requisites were filed on time, but it was not filed on proper form of the notice and as such, the appeal stood dismissed. In view of the facts & circumstances, the restoration petition is allowed.
Let M.A. No. 461 of 2011 be restored to its original file provided requisites in terms of order dated 06-12-2012 is filed within a period of two weeks from today, failing which, M.A. No.
Patna High Court MJC No.4676 of 2014 (4) dt.24-06-2015 2/2 461 of 2011 shall stand dismissed without further reference to a bench. Office may utilize earlier documents filed by the petitioner.
