16-08-2017 Heard Sri Vivekanand Singh, learned counsel for the petitioner and Sri Nityanand Tiwary, learned Addl. Public Prosecutor.

This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, the prayer for bail was rejected on 08-12-2016, vide Cr. Misc. No. 42721 of 2016. The petitioner is in custody since 17-07-2016 in Barh P.S. Case No. 234 of 2016 registered for offence under Sections 20(b)(ii), 22, 27 of the Narcotic Drugs & Psychotropic Substances Act, 1985.

The recovered quantity of Ganja and Charas, as submitted by learned counsel for the petitioner, was of smaller quantity and at least, one of the co-accused, almost on similar accusation, has already been extended the privilege of bail. He

Patna High Court Cr.Misc. No.31870 of 2017 (2) dt.16-08-2017 2/2 submits that considering the fact that petitioner has remained in jail for sufficient time as well as considering the smaller quantity of recovered Ganja and Charas, the Court may extend the privilege of bail.

Considering the fact that there was recovery of smaller quantity as well as the fact that petitioner has remained in jail for sufficient time, there is no reason to further detain the petitioner.

Accordingly, let the petitioner namely Sanjay Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District Judge - X, Patna in connection with Special Case No. 41 of 2016, arising out of Barh P.S. Case No. 234 of 2016.
