JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-11-2018 The learned counsel for the petitioner has made a short prayer to the effect that he has filed a representation before the Collector, Katihar, however, the same has not been disposed of, hence, the same be directed to be disposed of. In fact, the petitioner has prayed for the following reliefs:- "(1). That this is an application for issuance of an appropriate writ, order or direction, directing the respondent concern to consider the objection of the petitioner regarding selection of respondent no. 6 for grant of P.D.S. Licence in Chaukiya Paharpur Panchayat under Amdabad Block in the District of Katihar in as much as respondent no.

6 is the resident of West Bengal but by committing fraud and misrepresentation of fact he has been selected although on the same ground another candidate Saudagar Chaudhary was not selected and after considering the objection of the petitioner selection of respondent no. 6 may be cancelled and petitioner may be selected.

And for any others reliefs for which the petitioner is found to be entitled in the facts and

In view of the limited prayer of the petitioner, I deem it fit and proper to direct the petitioner to approach the Collector, Katihar by filing a representation within a period of four weeks from today and in case, such a representation is filed, the Collector, Katihar shall pass a speaking and reasoned order within a period of eight weeks thereafter.

The present writ petition is disposed of on the aforesaid terms.
