The petitioner seeks pre-arrest bail in connection with Salkhua P.S. Case No. 65 of 2019 for the offences alleged under Sections 341, 323, 420, 406, 467, 468 and 120B of the Indian Penal Code and 138 of the Negotiable Instrument Act. The accusation is that informant given the premium, amounting to Rs.30,000/- + Rs.30,000/-, of the Life Insurance Corporation of India to Pappu Choudhary, to deposit, who is the agent, but, later on the informant came to know that only Rs.13,000/- and Rs.3,500/- is deposited as premium in the Life Insurance Corporation of India. Similarly, Rs.35,000/- has been given to Prakash Choudhary to deposit the premium, but, only Rs.3,549/- has been deposited and Rs.30,000/- has been given to Manku Sada, who deposited only Rs.5,000/- as premium.

No.59276 of 2019(2) dt.19-09-2019 2/2 The submission of the learned counsel for the petitioner is that in fact the petitioner is resident of village of the informant, but, since, he use to reside in his sasural at village Harewa, P.S. Salkhua, Saharsa, and due to dirty village politics, he lodged the Complaint Case No. 376 of 2014 against the petitioner and his other family members.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Salkhua P.S. Case No. 65 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Saharsa, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
