The petitioner, who is in custody since 01.12.2008, seeks bail in connection with Sessions Trial No. 479 of 2009 arising out of Bibhutipur P.S. Case No. 13 of 2002, dated 01.02.2002, instituted for the offences under Sections 147, 148, 149, 364 and 302 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is one of the assailants of the deceased.

Patna High Court CR. MISC. No.65112 of 2019(4) dt.17-03-2020 2/2 This Court has taken note of the fact that the petitioner has been made accused in about 13 cases. It has been pointed out by the learned counsel for the petitioner that one of such cases has been repeated twice in the list of cases against him. In five of such cases, the petitioner stands acquitted and except in three other cases, the petitioner is on bail in all other cases.

Considering the nature of accusation against the petitioner, notwithstanding his period of custody from 01.02.2002, I am not inclined to grant bail to him for the present.

The petitioner may renew his prayer for bail if he is granted bail in all cases in which he was earlier made an accused.

The application stands disposed off with the aforesaid observations.
