2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. 151.890 litres of foreign liquor has been recovered from drain situated in front of the house of one Jageshwar Sah.
4. It is submitted by the counsel for petitioner that no incriminating article has been recovered from conscious possession of this petitioner. Petitioner has been falsely implicated in this case merely on suspicion and he has got no concern with the seized liquor. Petitioner claims clean antecedent.
5. Considering the facts aforesaid and clean
Patna High Court CR. MISC. No.64278 of 2023(2) dt.17-10-2023 2/2 antecedent, the petitioner above-named in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Court No. II, Muzaffarpur in connection with Maniyari P.S. Case No. 230 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
