Mr. SATYENDRA NARAYAN SINGH ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 10-08-2017 I have heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences punishable under Section 37 (a) (b) (c) of the Bihar Prohibition and Excise Act, 2016 and section 25 (a -b) a/26/35. It is contended that, as per allegation, one pistol and three live cartridges were recovered from beneath the driver's seat of Alto car which met with an accident and which was being driven by one Bipul Kumar and petitioner has been found in drunken state. It is further contended that there is no recovery of any incriminating article from the possession of the petitioner and the vehicle does not belong to him . Petitioner claims that he is having clean antecedent and is in custody since 19.5.2017.

No.35591 of 2017(2) dt.10-08-2017 2/2 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Roopuspur P.S. Case No. 144 of 2017 (Special Case No. 1854/2017).

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
