The petitioners apprehend their arrest in connection with Taraiya P.S. Case No. 177 of 2013 registered under Section 304/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Saran at Chapra.
The accusation is that when grandson of informant, Gopal Rai, went to drink water on hand-pump and caught hold the handle of the said hand-pump then he fell down due to electric shock and died. The wire of electric was connected with the handpump by these petitioners for earthing. Earlier, several peoples
Patna High Court Cr.Misc. No.51382 of 2014 (2) dt.14-05-2015 were felt due to electric shock after catching holds the handle of the hand-pump.
Learned counsel for the petitioners submits that it would appear from the F.I.R. that there is no intention to commit the murder of the grandson of the informant.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners Accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
