Petitioner seeks regular bail in connection with Patrakar Nagar P.S. Case No.194 of 2017 registered for the alleged offences under Sections 419, 420, 406, 468, 274, 276 & 120 B of the Indian Penal Code and Sections 27 (a), 27 (c), 27 (6) (ii), 28, 28 (4), 18 (A), 18 (B), 17 (A), 17 (B), 18 (A) (1), 18 (a) & 36 (A) of the Drugs and Cosmetic Act.
As per the prosecution case, the house of the petitioner was raided where sale and manufacturing of the illegal drugs was going on and uncovered label, unlabelled vial and other unused labels got printed by the co-accused Amit Kumar were recovered.
It has been submitted by learned counsel for the
Patna High Court Cr.Misc. No.34050 of 2017 (02) dt.20-07-2017 2/2 petitioner that the petitioner has no concern with the aforesaid illegal business of drugs. The petitioner happens to be the owner of the premises and has let out two rooms to Amit Kumar and the said incriminating article was recovered from the room of the Amit Kumar. The seizure list also indicates the petitioner to be the owner of the aforesaid premises. He has been languishing in jail custody since 21.04.2017.
In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Sub Judge X-cum-A.C.J.M., Patna in connection with Patrkarnagar P.S. Case No.194 of 2017.
