Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is evident from perusal of contents of first information report that petitioner was caught by the co-villagers of the informant with the help of villagers of one Bankora village while his associates fled away from the place of occurrence. The contention on behalf of the petitioner is that petitioner is a innocent and as a matter of fact, he was fleeing away on the alleged date of occurrence but unfortunately he was caught by the villagers on the basis of suspicion. Petitioner does not have any criminal antecedent.

Patna High Court Cr.Misc. No.50721 of 2014 (4) dt.02-04-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant privilege of bail. Accordingly, his prayer for bail in connection with Jokihat P.S.Case No. 295 of 2014, pending in the court of Chief Judicial Magistrate, Araria stands rejected at least at this stage.
