JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-11-2015 Heard learned counsels for the petitioners and the State. The petitioners being elder brother and his wife are apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The accusation is of killing the daughter of the informant after about five years of marriage for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioners that investigation against the petitioner is still pending. Statement to the aforesaid effect has been made in paragraph 12 of the petition. It is further submitted that the trial of the husband of the
Patna High Court Cr.Misc. No.54158 of 2015 (2) dt.30-11-2015 2/2 victim has already commenced where none of the witnesses have supported the accusation.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhojpur at Ara in connection with Sahar P.S. Case No.41 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
