The petitioner seeks bail in connection with Aurangabad Muffasil P.S. Case No. 245 of 2021 instituted for the offences under Section 30(a) of the Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 29.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 162.750 litres of liquor from a tempo.

Learned counsel for the petitioner submits that the petitioner was merely a passenger and as such was not aware what was kept in the tempo.

Considering the fact that the petitioner is in custody since 29.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise, Aurangabad in connection with Aurangabad Muffasil P.S.
