JUSTICE SHIVAJI PANDEY ORAL ORDER 27-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Saharsa Sadar P.S. Case No.767 of 2016, registered for the offence punishable under Sections 341, 323, 447, 504, 307, 379/34 of the Indian Penal Code. Allegation has been made that the petitioner along with 5 to 6 unknown persons armed with different weapons entered into the house of the informant and started hurling abuses and later on started assaulting her. When her son tried to flee away, then on instigation of accused Sunita Devi accused Raja Yadav made indiscriminate firing, but none has sustained injury, rather the pellet hit the wall of the house.

Accordingly, the prayer for bail is rejected. If the petitioner surrender before the Court below within four weeks from today and prays for bail, the Court below will pass the order in accordance with law without being influenced by the order of this Court.
