2. The mother of the petitioner was Assistant Teacher in Middle School, Bathani in the district of Gaya and she died in harness on 14.05.2021. The petitioner, being the heirs and legal representative, after completing all the paraphernalias, made his claim for appointment on compassionate ground on 14.08.2021 before the District Education Officer, Gaya. Thereafter, he moved from pillar to post before the respondent authorities for redressal of his grievances but no result has yet yielded. Hence, this writ application.

3. Having heard learned counsel for the parties and on going through the materials available on record, in my view, no useful purpose would be served in keeping this writ application pending.

4. Accordingly, this writ application is disposed of with a direction to the petitioner to file a fresh representation before the District Magistrate, Gaya (respondent no.4) along with a copy of this order within a period of four weeks. The District Magistrate, Gaya (respondent no.4) is directed to consider the case of the petitioner sympathetically and pass a reasoned and speaking order within ten weeks from the date of its receipt.

5. It is made clear that District Magistrate, Gaya shall be solely responsible for non-compliance of this order within the stipulated period.
