JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-10-2022 Learned counsel for the petitioner submits that the Title Suit No. 154 / 1995 was filed by the plaintiff -respondent for declaration of right, title and interest and recovery of possession. He next submits that the title suit is pending for about last 27 years and despite evidence of both the parties having been closed in the year 2000 itself, the title suit is still pending and has not been disposed by the learned Subordinate Judge -Ist Danapur. Accordingly, submission is that direction be issued to the concerned court for disposal of the title suit as early as possible.
Taking into consideration the submission of learned
Patna High Court C.Misc. No.1580 of 2018(2) dt.13-10-2022 2/2 counsel appearing for the petitioner and fact that the title suit is about 27 years old and evidence of both the parties have come to end, accordingly, I direct the learned Subordinate Judge-Ist Danapur to fix the case for argument within a period of 15 days from the date of receipt / production of a copy of this order and dispose the Title Suit No. 154 / 1995 within a further period of three months positively.
With the aforesaid observation and direction, the application stands disposed of.
