JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Trial court has reported that up till now, four prosecution witnesses have already been examined and two public witnesses and one I.O are left to be examined and to procure the attendance of the aforesaid witnesses, steps have already been taken.

Earlier prayer for bail of the petitioner was rejected by this court, again, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 25.1.2016 passed in Cr. Misc. no 2188/2016 and accordingly, his prayer for bail in connection

Patna High Court Cr.Misc. No.34993 of 2017 (3) dt.30-08-2017 with Session trial no. 453 of 2015 arising out of Harnaut P.S. Case no. 283/2015 pending in the court of Addl. Sessions Judge I, Nalanda at Biharsharif stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible preferably, within four months from the date of receipt/production of a copy of this order even by taking trial of the petitioner on day to day basis. Let copy of this order be sent to Superintendent of Police, Nalanda at Biharsharif with direction to him to ensure the presence of remaining prosecution witnesses before the concerned court within one month from the date of receipt/production of a copy of this order. However, petitioner may renew his payer for bail, if his trial is not concluded within the above stated period of four months.
