====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2023 Heard learned counsels for the petitioner, complainant and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 409, 420, 120(B) and 499 of the Indian Penal Code.

It is alleged that complainant paid Rs. 1,57,000/- cash to the petitioner for supplying the bricks. Despite repeated requests, petitioner did not supply the bricks. Learned counsel appearing for the petitioner submits that petitioner has already supplied bricks worth Rs. 1,57,000/- to the complainant and when the petitioner demanded money for the same, complainant lodged this false and concocted case

Patna High Court CR. MISC. No.62066 of 2022(3) dt.01-05-2023 2/2 against him. He next submits that there is no chit of paper to substantiate the alleged allegation against the petitioner. Petitioner has got clean antecedent.

Learned counsel for the complainant vehemently opposes the bail application.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Begusarai in connection with Complaint Case No. 599C of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
