Petitioner seeks bail in connection with S. Tr. No. 435 of 2016 arising out of Jagdishpur P.S. Case No. 51 of 2016 registered under Sections- 304B, 201, 120B of the Indian Penal Code.
Informant alleged that his sister was married to one Pankaj Yadav a year back and there was a demand for dowry. On 23.02.2016 the informant received telephonic information about the death of the deceased and the in-laws had fled away from the house. Informant suspected that the deceased was done to death.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.54079 of 2016 (3) dt.15-02-2017 2/2 allegation of demand of dowry is not against this petitioner. Prior to the occurrence, informant had no grievance. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that petitioner, who is husband, is named accused. Considering the nature of allegations levelled against the petitioners and the submissions made on behalf of the State, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
