Earlier prayer for bail of the petitioner was refused by this Court vide order dated 29.09.2021.

From perusal of trial court's report it appears that the case is pending for statement under section 313 Cr.P.C of accused persons since 02.07.2018 and till date, on one pretext or the other, statement of the accused persons could not be recorded and case is running for the last five years. Report also reveals that the defence which is adopting all means of delaying tactics to prolong the trial.

Considering the conduct of the defence, prayer for bail of the petitioner is refused.

As the petitioner is already in custody since, 10.10.2015, let the trial be concluded as early as possible preferably within a period of one year from the date of receipt of this order.
