Heard learned counsels for the petitioner and the State.

The petitioner is languishing in custody since 12.06.2013 in a case registered for the offences punishable under Sections 457, 380 and 411/34 of the Indian Penal Code. The accusation is of committing theft of motorcycle by petitioner and other three persons. On chase the petitioner along with three persons were apprehended with the motorcycle.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.519 of 2015 (02) dt.09-01-2015 2/2 petitioner that the petitioner has no criminal antecedent, statement to that effect has been made in para 3 of the petition and only on suspicion the petitioner has been roped in the present case whereas co-accused Kundan Kumar has been granted bail vide Cr. Misc. No. 50899 of 2013.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Raxaul, Motihari, East Champaran in connection with Raxaul P.S.
