This application under Section 439(2) of the Code of Criminal Procedure has been filed by the petitioner to cancel the bail bond of opposite party no. 2, furnishing in the light of order dated 24.07.2019 passed in A.B.P. No. 979 of 2019, whereby the court of 4th Additional Sessions Judge, Madhubani, granted privilege of pre-arrest bail to the opposite party no. 2 in connection with Jaynagar P.S. Case No. 684 of 2018. Learned counsel for the petitioner submits that the petitioner was not given opportunity at the time of hearing of A.B.P No. 979 of 2019, in which, the court of learned 4th Additional Sessions Judge, Madhubani, granted privilege of
Patna High Court CR. MISC. No.60936 of 2019(2) dt.26-09-2019 2/2 pre-arrest bail to the opposite party no. 2 in connection with Jaynagar P.S. Case No. 684 of 2018 but nothing has been detailed about misused of privilege of pre-arrest bail by the opposite party no. 2 of the present application. In view of the aforesaid fact, I am not inclined to interfere in the order dated 24.07.2019 passed in A.B.P. No. 979 of 2019 and accordingly, this application stands dismissed.
