The present application has been filed for modification of the order dated 15.2.2019 passed in Cr. Misc. No.9018 of 2019 in connection with Budha Colony P.S. Case No. 393 of 2018 registered for the offences punishable under Sections 341,323,504,506,420 and 406/34 of the IPC pending in the Court of the learned ACJM XI, Patna to the extent of extending the period of surrender of the petitioner.

The factual matrix of the case is that the petitioner being a lady was granted anticipatory bail vide order dated 15.2.2019 passed in Cr. Misc. No. 9018 of 2018 and she was supposed to surrender within twelve weeks.

No.56278 of 2019(2) dt.11-09-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner could not surrender due to the fact that she is suffering from carcinoma in breast and she was undergoing chemotherapy and therapy after surgery. Similar prayer of the petitioner was also allowed by this Court vide order dated 31.7.2019 passed in Cr. Misc. No. 31935 of 2019.

Considering the fact that the petitioner is a lady and in view of the nature of ailment she is suffering from, the date of surrender of the petitioner is extended by 14th October, 2019 in connection with the aforementioned case.
