2. The petitioner apprehends his arrest in connection with Mashrakh P. S. Case No. 96 of 2017, registered for the offences punishable under Sections 341, 323, 504, 506, 420, 467, 468 and 120(B) of the Indian Penal Code.

3. At the outset, learned Advocate for the petitioner submits that the petitioner is absconding for last six years.

4. On perusal of the F.I.R., it is ascertained that entire allegation regarding cheating of the complainant was levelled against the said petitioner. It is alleged that on

Patna High Court CR. MISC. No.62267 of 2023(3) dt.08-12-2023 2/2 being asked, the complainant handed over all the documents relating to ownership of his landed property, a sum of Rs. 1,24,000/- and also the signatures of the guarantors to the accused for obtaining loan of Rs. 15 lakh. The loan has not been received by the complainant. There is a chance of recovery of the documents of ownership of the property and money only when the accused be taken to custody.

5. In view of such circumstances, I am not inclined to release the accused on anticipatory bail. Accordingly, prayer for anticipatory bail of the petitioner is rejected.
