2. In this case, the petitioner is seeking regular bail in connection with N.D.P.S. G.R. Case No. 51 of 2024 arising out of Ghorasahan (Jharokhar) P.S. Case No. 261 of 2024, registered for the offences punishable under Sections 8(c) and 22(a) of the N.D.P.S. Act.

3. As per allegation, on the tip off, one team was constituted and the informant along with other official raided the place of occurrence where one person riding on a motorcycle and was trying to go to Nepal from India was apprehended who disclosed his name as Irfan Khan. Several prohibited medicines were recovered from the apprehended accused person. Later on, the petitioner was also arrested on the basis of confidential information.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He is a person of clean antecedent. He is under custody since 10.06.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari in connection with N.D.P.S. G.R. Case No. 51 of 2024 (arising out of Ghorasahan (Jharokhar) P.S. Case No. 261 of 2024), subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) One of the bailors must be a citizen of India. (iii) Before release, the learned court below shall verify the criminal antecedent of the petitioner and if he is found involved in any case other than the case as mentioned in para-3 of the bail petition, his bail bond shall not be accepted.
