The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 23.08.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of one country-made pistol along with a lighter and a mobile from the house of the petitioner.

The learned counsel for the petitioner submits that

No.71753 of 2021(2) dt.17-05-2022 2/2 petitioner has been falsely implicated in the present case as in the F.I.R., it is alleged that police had information that petitioner was carrying pistol in his hand and threatened the people of Chhathia Tola on which the police arrived and thereafter, falsely implicated him by showing recovery of pistol from his house. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and is a young boy of 24 years of age, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Govindganj (Malahi) P. S. Case No.255 of 2021.

The application stands allowed.
