2. The petitioners seeks bail in connection with Azamnagar P.S. Case No. 126 of 2024 registered for the offence under Sections 366(A)/34 of the I.P.C.

3. Petitioner are named in the F.I.R. and are in custody since 27.06.2024.

4. The allegation against the petitioners are to kidnap the minor daughter of the informant aged about 13 years along with other co-accused persons/family members for the purpose of illicit intercourse/illegal

Learned counsel appearing on behalf of the petitioners submitted that petitioner implicated with present case only being the parents and relatives of the main accused, namely, Narayan Mandal against whom the thrust of allegation is available. It is submitted that petitioner nos. 1 and 2 are the parents and petitioner no. 3 is the sister of the main accused, namely, Narayan Mandal. While concluding the argument, it is submitted that all petitioners are of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer of bail.

7. In view of aforesaid factual submission and by taking note of fact that implication of petitioners prima-facie appears being the parents and relative of the main co-accused, namely, Narayan Mandal, coupled with fact that charge-sheet has already been submitted where

No.64115 of 2024(2) dt.11-09-2024 3/3 petitioners are in custody since 27.06.2024, accordingly all above named petitioners, are directed to be released on bail in connection with Azamnagar P.S. Case No. 126 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/Section 480(3) of BNSS.
