1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 149, 324, 307, 379, 504 and 506 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner along with five others had moved earlier before this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 23205 of 2024, but then petitioner herein was arrested during pendency of Criminal Miscellaneous No. 23205 of 2024, as such, his anticipatory bail application was permitted to be withdrawn by an order dated 25.04.2024 and rest five petitioners of Criminal Miscellaneous No. 23205 of 2024 were granted the privilege of anticipatory bail. It is next submitted that petitioner is in custody since 18.03.2024 and is a person with clean antecedent and is alleged to have assaulted Suresh by farsa on account of dispute

Patna High Court CR. MISC. No.44839 of 2024(2) dt.21-09-2024 2/2 relating to land. It is further submitted that the facts of the case have been recorded in detail in Criminal Miscellaneous No. 23205 of 2024. It is next submitted that from perusal of Annexure-2, at Pages 19 and 20 to the regular bail application, it would manifest that Suresh suffered simple injury caused by hard and blunt substance. It is also submitted that charge sheet has been submitted.

4. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bakhtiyarpur P.S. Case No. 493 of 2023.

6. Accordingly, the instant regular bail application stands allowed.
