2. The petitioners are in custody since 30.05.2017 in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 251 of 2017 for the offences alleged under Sections 302, 34 of the Indian Penal Code.
3. It is submitted that the petitioners have been falsely implicated and admittedly there was land dispute between the parties. The petitioner no. 1 and the deceased were own brothers and the petitioner no. 2 is the son of the petitioner no. 1. Except suspicion, there is no material to connect the petitioners with the alleged offence. Petitioners claim clean antecedents.
4. Having regard to the nature of accusations and
Patna High Court Cr.Misc. No.36792 of 2017 (3) dt.22-09-2017 gravity of the offence alleged, this Court is not inclined to grant the privilege of bail to the petitioners. The bail petition stands dismissed.
