2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 395 of the Bharaitya Nyaya Sanhita, 2023.
3. The case of the prosecution in short is that 5-6 miscreants entered in the house of the informant and committed dacoity.
4. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation one Vikash Kumar has given his confessional statement. The name of this petitioner has surfaced in the confessional statement of co-accused Vikash Kumar. It has been submitted that nothing has been recovered from the
Patna High Court CR. MISC. No.62502 of 2025(3) dt.27-11-2025 2/2 possession of this petitioner, rather recovery has been made from the possession of Vikash Kumar. Learned counsel for the petitioner has submitted that the petitioner is a man of clean antecedent and is in judicial custody since 16.05.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Fatuha P.S. Case No. 180 of 2019 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna City.
