The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Patepur P.S. Case no. 139 of 2021 instituted for the offence punishable under Sections 147, 148, 149, 188, 224, 323, 341, 342, 353, 332, 333, 504 and 506 of the Indian Penal Code. As per allegation in the FIR, informant with other police officials proceeded towards the house of the petitioner for his arrest as he was also an accused in Patepur P.S. Case No. 89 of 2021 registered under the Excise Act. Police personnel caught hold him but several accused persons tried to get him free from their clutches. During this course 10-15 persons armed with weapons attacked on the police force and due to which the apprehended accused, who is the petitioner in the present case,

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The entire prosecution story is false and concocted. No occurrence as alleged took place. Several co-accused persons have been granted anticipatory bail by the learned lower court. Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Patepur P.S. Case no. 139 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
