JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 328,302 and 120B/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after 15 years of marriage.
It is submitted by the learned counsel for the petitioner that the accusation is not specific against the petitioner and admittedly the informant is not the eye witness to the occurrence. The impugned order also does not reflect any direct material collected during investigation against the petitioner. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.54685 of 2015 (2) dt.03-12-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Jalley P.S. Case No.95 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
