Mr. Gyan Shankar, AC to GP-2 =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI and HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) Date: 09-03-2017 Heard learned counsel for the appellants, counsel for the private-respondent nos. 8 to 15 and counsel for the State. Writ application of these appellants came to be dismissed by the Learned Single Judge vide order, dated 16.09.2013. The primary reason for dismissal of the writ application seems to be that these appellants never made any grievance or raised any cause of action before the competent authority after the appointment of the private-respondents way back in the year 2007 and that such appointment was not required to be interfered with after almost a decade, since settled position cannot be unsettled just at the asking and convenience of these appellants.

The Court is of the opinion that the conclusion reached for rejecting the prayer of these appellants in the writ application are both cogent and valid reasons and the same is not required to be interfered with.

Patna High Court LPA No.1675 of 2013 dt.09-03-2017 3/3 Appeal has no merit. It is dismissed.
