The petitioner seeks bail in connection with Rail Khagaria P.S. Case No. 28 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 24.030 litres of liquor from a bag alleged to be carried by the petitioner while he was at Khagaria Railway Station.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.71768 of 2021(2) dt.28-02-2022 2/2 petitioner has been falsely implicated in the case, the real culprits fled leaving the bag and the petitioner, who was standing at the place of occurrence, came to be implicated with false allegation.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Rail Khagaria P.S. Case No. 28 of 2021 (Satyavrat Verma, J) Rishi/- U T
