The petitioner is in custody since 17.05.2017 in connection with Salkhua P.S. Case No. 85 of 2017 for the offence registered under Sections 341, 323, 302, 379, 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner did not transpire in the first information report, and subsequently, on the basis of the statement made before the police by Durga Kumar and Dular Chandra name of the petitioner has been brought in. It is further submitted that the petitioner has been implicated in this case due to village politics. It is further submitted that the petitioner cannot be implicated on the basis of the confessional statement made before the police, which has no evidentiary value.
