This Letters Patent Appeal is being filed against the judgment dated 03.08.2016 passed by a learned Single Judge of this Court in CWJC No. 8031 of 2012 whereby the Court has set aside the part of the impugned order dated 11.04.2012 issued by the Executive Engineer, Rural Works Department, Works Division, Rosra and part of the order dated 07.12.2011 passed by the Empowered Standing Committee and thereby has issued
Patna High Court L.P.A No.2194 of 2016(9) dt.08-01-2020 2/2 direction to the respondent authorities to refund the amount of security deposit to the petitioner.
Respondent has chosen not to contest the writ petition/appeal despite service of notice.
We do not find any reason sufficient enough to interfere with the impugned judgement dated 3.8.2016. However, we clarify that it shall be open for the appellant herein to take appropriate action in accordance with law after affording opportunity of hearing to the parties concerned.
