JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 376G of the Indian Penal Code and Section 3/4 of The Protection of Children from Sexual Offences Act.

The accusation is of ravishing the informant by accused persons in Sokho forest. Subsequently the victim was examined under 164 Cr. P.C. where she got her age recorded as 22 years when the court assessed her age as 19 years where she stated that under pressure of her family, she lodged the case with false accusation. In fact she has married with Idris Ansari in Apri, 2015 and none ravished her. Considering 164 Cr. P.C. statement of the victim, other co-accused Reyaz Ansari has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr.

Patna High Court Cr.Misc. No.56198 of 2015 (2) dt.10-12-2015 2/2 Misc. No. 40395 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui in connection with Khaira P.S. Case No. 121 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
